However, it is not possible to guarantee a precise date or time of delivery, as the service is provided by an external supplier. Therefore, the Seller is not liable in any way for any delays, failed delivery, damage or other consequences relating to the shipping and delivery service, without prejudice to the Seller's willingness to cooperate with the Customer to resolve issues relating to such service.
The delivery times indicated above may also vary during periods of particular operational intensity, such as Black Friday, the Christmas holidays, the Ferragosto week, as well as in the event of transport strikes, force majeure events or other circumstances not attributable to the Seller.

The Seller shall not be held liable for delays, failed deliveries, additional costs, storage or returns resulting from incorrect, incomplete or inaccurate addresses provided by the Customer.
Should an order be returned to sender due to the recipient being unreachable, failure to collect the goods, unjustified refusal of delivery or incorrect indication of the address, the Seller may charge the Customer the costs incurred for the return and for any re-shipment.
Any requests to amend the delivery address after order confirmation will be handled in accordance with the progress of the shipment and cannot be guaranteed.
The Seller shall under no circumstances be held liable for purchases made by purchasers who have provided false or mendacious declarations, also in relation to the requirements for purchase.
14. TRANSFER OF RISK
Pursuant to art. 63 of Italian Legislative Decree 206/2005 (Codice del Consumo) where applicable to the case at hand, the risk of loss or damage to the products, for reasons not attributable to the Seller, shall transfer to the Customer at the moment the Customer, or a third party designated by the Customer and other than the carrier, materially takes possession of the products.
15. INSPECTION OF THE GOODS
Upon delivery, the Customer is required to verify, among other things, that:
· the packaging is intact, not damaged, wet, tampered with or otherwise altered;
· the number of packages corresponds to that indicated in the order;
· there are no evident signs of impact, crushing or breakage.
Should the Customer detect visible anomalies upon delivery, he/she is required to accept the shipment by placing a specific and detailed reservation on the courier's delivery document (for example: "damaged package", "crushed packaging", "wet package", "open package") or, in the most serious cases, to refuse delivery. By signing the delivery document without indicating such specific reservations, the Customer attests to the integrity of the Products and the correctness of the delivery.

The refund will be made within approximately 5 working days from receipt of the returned goods, only if, following the inspection carried out by the Seller, the Products are indeed intact, unused, undamaged, complete and in the original packaging. Refund times may vary depending on the payment circuit used.
18. EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply if:

The Seller is liable to the Customer for any lack of conformity existing at the time of delivery of the Product and which becomes apparent within the terms provided by applicable law.
In the case of wine products, the legal warranty covers exclusively the lack of conformity attributable to the product or to the packaging and distribution process, excluding effects deriving from the normal evolution of wine over time, from incorrect storage after delivery or from other circumstances not attributable to the Seller.
The rights recognized to the Customer by applicable law remain in any case unaffected.
20. WINE GIFT CARD
Wine Gift Cards are issued exclusively in digital format and sent to the e-mail address provided by the Customer when purchasing.
Wine Gift Cards purchased through the Website may be used exclusively for the purchase of Products.

Gift Cards are not convertible into cash and do not give the right to change.
The Gift Card must be used in a single transaction. Should the value of the purchase be lower than the nominal value of the Gift Card, the remaining amount cannot be reused for subsequent purchases and will not be refundable.
Should the value of the purchase be higher than the value of the Gift Card, the Customer must pay the difference using one of the available payment methods.
The value of the Gift Card is applied exclusively to the subtotal of the Products purchased and does not cover any shipping costs.
Shipping and delivery costs therefore remain borne by the Customer and will be calculated according to the conditions in force at the time of purchase, save for the reaching of any thresholds entitling to free shipping, where provided.
The Seller is not liable for any loss, theft, improper use or unauthorized access to the Gift Card by third parties.
