2. DEFINITIONS
For the purposes of these General Terms and Conditions of Sale:
· "Customer" means any natural person who purchases products or services through the Site for purposes unrelated to their business, commercial, craft, or professional activity;
· "Products" means the wines, gift packages, Gift Cards, and other goods sold through the Site;
· "Experiences" means guided tours, tastings, wine tourism activities, events, stays, and hospitality services purchasable through the Site;
· "Contract" means the sales contract concluded between the Customer and the Seller.
3. SCOPE OF APPLICATION
These General Conditions govern all purchases made through the Site.
By placing an order, the Customer declares that they have read, understood, and fully accepted these General Conditions of Sale.
These conditions are governed by applicable Italian law and, in particular, by Legislative Decree 206/2005 ("Consumer Code").
4. REQUIREMENTS FOR PURCHASE
The purchase of alcoholic beverages is permitted exclusively to subjects who have reached the age of eighteen.
By placing an order, the Customer declares and guarantees to be of legal age according to the applicable legislation in their Country of residence.
The Seller reserves the right to refuse, suspend or cancel orders should there be any doubts about the buyer's age.
The courier responsible for delivery may request the presentation of an identity document.
5. PRODUCTS AND AVAILABILITY
The descriptions of the products on the Site are provided for informational purposes.
Images are purely illustrative and may not perfectly represent the product actually delivered, including any graphic updates, packaging, vintages or aesthetic details.
Product availability is updated periodically but cannot be guaranteed in real time.
Should a ordered product be unavailable after order confirmation, the Customer will be promptly informed and may choose between:
· refund of the amount paid;
· replacement with an equivalent product, where available.
6. PRICES
All prices published on the Site are expressed in Euros and inclusive of VAT, where applicable.
Shipping costs are indicated separately before the conclusion of the purchase.
The Seller reserves the right to modify prices at any time. Changes do not apply to orders already confirmed.
7. PRICING, DESCRIPTION OR AVAILABILITY ERRORS
The Seller pays the utmost attention to the accuracy of the information published on the Site.
However, any material, typographical, IT or technical errors relating to prices, availability, descriptions or images of the products may occur.
Should an order be placed on the basis of an evident and recognizable error, the Seller reserves the right to cancel the order even after the receipt of the automatic confirmation.
In such cases, the Customer will be promptly informed and will be entitled to a full refund of any amounts already paid, without this entailing any further compensation obligation on the part of the Seller.
8. PURCHASE PROCEDURE
To make a purchase, the Customer must:
· select the desired products;
· add them to the cart;
· fill in the required details;
· select the payment method;
· confirm the order.
Submitting the order constitutes a contractual purchase proposal.
The Contract is considered concluded exclusively at the moment the Customer receives the order confirmation from the Seller.
The Seller reserves the right to refuse orders for legitimate reasons, including product unavailability, impossibility of delivery, pricing errors, or suspected fraudulent use of payment systems.
9. PAYMENT METHODS
Payments may be made using the systems indicated on the Site at the time of purchase.
Orders will be processed exclusively after confirmation of successful payment.
Transactions are handled by certified payment service providers compliant with applicable security standards.
The Seller neither stores nor has access to the full payment card details used by the Customer.
10. ELECTRONIC INVOICING
For purchases made by VAT-registered entities resident or established in Italy, the Customer may request the issuance of an electronic invoice by providing, at the time of the order, all data required for tax purposes, including business name, VAT number, and PEC address.
The invoice request must be made at the same time as the purchase. Once the tax document has been issued, no changes to the data entered may be requested, except in cases provided for by applicable law.
The electronic invoice will be issued and transmitted via the Exchange System (SDI) in accordance with the procedures and terms set out by applicable legislation.
For purchases made by private consumers, the commercial document or purchase receipt will be made available in accordance with the procedures set out by applicable law.
11. SHIPPING AND DELIVERY
Shipments are made via express courier.
For shipments within Italy, delivery is generally guaranteed within 5 working days from the order confirmation date.
The delivery times indicated above may vary during periods of particularly high operational intensity, such as Black Friday, the Christmas holidays, the Ferragosto week, as well as in the event of transport strikes, force majeure events, or other circumstances not attributable to the Seller.
Estimated delivery times for EU Countries depend on the destination country. To receive an estimate of delivery times, it is necessary to write to servizioclienti@feudi.it.
Upon shipment, the Customer will receive a communication containing the tracking number to monitor the delivery status.
The Seller will not be liable for delays attributable to the courier or circumstances beyond its control.
In the event of significant delays or delivery issues, the Customer may contact customer service at servizioclienti@feudi.it.
12. PROTECTING WINE QUALITY DURING TRANSPORT
In order to preserve the quality of the products, the Seller reserves the right to temporarily postpone shipments in the presence of particularly adverse weather conditions, such as heat waves, intense frost, or other events that may compromise the proper preservation of the wine during transport.
In such cases, the Customer will be promptly informed.
13. CUSTOMER RESPONSIBILITY FOR DELIVERY DATA
The Customer is responsible for the accuracy, completeness, and up-to-dateness of the data provided during the purchase procedure, including name, surname, delivery address, telephone number, e-mail address, and any other information necessary for the fulfillment of the order.
The Vendor cannot be held liable for delays, failed deliveries, additional costs, storage fees, or returns resulting from incorrect, incomplete, or inaccurate addresses provided by the Customer.
If an order is returned to the sender due to the recipient being unreachable, failure to collect the goods, unjustified refusal of delivery, or incorrect address details, the Vendor may charge the Customer the costs incurred for the return and for any reshipment.
Any requests to change the delivery address after order confirmation will be handled in accordance with the progress of the shipment and cannot be guaranteed.
14. TRANSFER OF RISK
Pursuant to art. 63 of Legislative Decree 206/2005 (Italian Consumer Code), the risk of loss or damage to the products, due to causes not attributable to the Vendor, transfers to the Customer at the moment when the Customer, or a third party designated by the Customer other than the carrier, physically takes possession of the products.
15. INSPECTION OF THE GOODS
Upon delivery, the Customer is required to verify that:
· the packaging is intact, undamaged, wet, tampered with, or otherwise altered;
· no evident signs of impact, crushing or breakage are present.
Should the Customer notice visible anomalies upon delivery, they are invited to accept the shipment by placing a specific and detailed note on the courier's delivery document (for example: "damaged parcel", "crushed packaging", "wet parcel", "opened parcel") or, in more serious cases, to refuse delivery.
Any damage, discrepancies or shortages must be communicated to the Seller within 48 hours of delivery, by sending a report to the address servizioclienti@feudi.it accompanied, where possible, by photographic documentation.
Failure to report within the terms indicated above may limit the Seller's ability to activate complaint procedures with the carrier responsible for delivery.
16. RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the Contract within 14 days of delivery of the products without obligation to provide reasons.
The communication must be sent to the address servizioclienti@feudi.it.
17. EFFECTS OF WITHDRAWAL
Products must be returned intact, complete, and in their original packaging.
The refund will be issued within approximately 5 business daysfrom receipt of the returned goods, provided the products are indeed intact,complete, and in their original packaging. Refund times may vary depending on the payment method used.
Return shipping costs are borne by the Customer unless otherwise indicated by the Seller.
18. EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply if:
· the products have been personalized or made to the Customer's specific requests;
· the bottle has been opened;
· The wine was improperly stored by the Customer after receipt, altering its value.
And to the other cases provided for by art. 59 of the Consumer Code.
19. LEGAL GUARANTEE OF CONFORMITY
All products sold through the Site are covered by the legal guarantee of conformity pursuant to articles 128 and following of Legislative Decree 206/2005 (Consumer Code).
The Seller is liable to the consumer for any lack of conformity existing at the time of delivery of the product and which becomes apparent within the terms provided by current legislation.
For wine products, the legal guarantee exclusively covers lack of conformity attributable to the product or to the packaging and distribution process, excluding effects deriving from the normal evolution of the wine over time, from improper storage after delivery, or from other circumstances not attributable to the Seller.
In any case, the rights recognized to the consumer by current legislation remain unaffected.
20. WINE GIFT CARD
Wine Gift Cards are issued exclusively in digital format and sent to the e-mail address provided by the Customer at the time of purchase.
The Customer has the right to withdraw from the Contract within 14 days of receiving the Wine Gift Card without obligation to provide reasons, provided that the Wine Gift Card has not already been used.
Wine Gift Cards purchased through the Site can be used exclusively for the purchase of wines and gift packages.
Each Wine Gift Card is identified by a unique code. Unless otherwise indicated at the time of purchase, Gift Cards are valid for a period of 12 months from the date of purchase.
Gift Cards can be used:
· online on the Website;
· at the wine shop of the Feudi di San Gregorio winery, located in Sorbo Serpico (AV).
Gift Cards cannot be converted into cash and do not entitle the holder to any change.
The Gift Card must be used in a single transaction. If the value of the purchase is less than the nominal value of the Gift Card, the remaining amount cannot be reused for subsequent purchases and will not be refundable.
If the value of the purchase exceeds the value of the Gift Card, the Customer must pay the difference using one of the available payment methods.
The Gift Card value is applied exclusively to the subtotal of the purchased products and does not cover any shipping costs.
Shipping costs therefore remain the responsibility of the Customer and will be calculated according to the conditions in force at the time of purchase, unless any thresholds entitling to free shipping are met, where provided.
The Seller is not responsible for any loss, theft, improper use, or unauthorized access to the Gift Card by third parties.
21. WINE TOURISM EXPERIENCE VOUCHERS
Experience vouchers are issued exclusively in digital format and sent to the e-mail address provided by the Customer during purchase. Each voucher is identified by a unique code and is valid on the days and until the date indicated on the voucher itself. The voucher can only be used upon reservation and subject to availability of the facility.
The Customer has the right to withdraw from the Contract within 14 days of receiving the voucher without obligation to provide a reason, provided the voucher has not already been used.
The communication must be sent to the address servizioclienti@feudi.it.
The date of the Experience may be changed, subject to availability, if requested at least 24 hours before the booked time – or at least 3 days before check-in, if the voucher also includes overnight stay.
The Experience begins exactly at the time indicated in the booking confirmation. Any delays must be promptly communicated.
Extensions to the booking cannot be guaranteed in case of delays.
In case of a delay of more than five minutes not previously communicated, the booking will be automatically cancelled.
In case of no-show, unless otherwise indicated, no refund will be provided.
Any dietary requirements, intolerances, or allergies must be communicated at the time of booking or, in any case, with at least 24 hours’ notice. After this deadline, the Seller cannot guarantee the ability to accommodate special requests.
22. PROMOTIONS AND DISCOUNT CODES
Promotional codes and any commercial initiatives activated by the Seller are valid exclusively for the indicated period and according to the terms communicated from time to time.
Discount codes cannot be combined with each other or with other promotions, agreements, or ongoing commercial initiatives.
Discount codes do not apply to the following products and services:
· Personalized bottles
· Gift Card
· Wine tourism and hospitality experiences
· Products already on sale
· Vintage wines and gift packages containing them
· FeudiStudi and gift boxes containing them
· Cru di Basilisco and gift boxes containing them
· Goleto e Gulielmus and gift boxes containing them
· Torre alle Comete and gift boxes containing it
· Limited editions and labels whose proceeds are entirely donated to the Fondazione di Comunità San Gennaro
· “Lella e Massimo Vignelli e Feudi di San Gregorio” edited by Domitilla Dardi and gift box containing it
· Other products expressly indicated on the Site
The list of excluded products may be updated by the Seller at any time. Any further limitations or exclusions will be indicated in the conditions of the specific promotion or in the relevant commercial communications.
The Seller reserves the right to suspend, modify, or revoke promotions and discount codes in the event of material errors, misuse, fraudulent activities, or circumstances that make modification necessary.
23. INTELLECTUAL PROPERTY
All content on the Site, including trademarks, logos, photographs, texts, videos, graphics, and layouts, is the property of the Seller or the respective rights holders.
Any unauthorized reproduction, distribution, or use is prohibited.
24. PERSONAL DATA PROCESSING
Personal data is processed in compliance with current applicable regulations on the protection of personal data.

25. APPLICABLE LAW AND JURISDICTION
These General Conditions are governed by Italian law.
For any dispute relating to the validity, interpretation or execution of these Conditions, if the Customer qualifies as a consumer, the court of the place of residence or domicile of the consumer shall have jurisdiction.
The right of the consumer to make use of the out-of-court dispute resolution procedures provided for by current legislation remains unaffected.
